Trial Date Set For Rescue Squad Land Dispute

Circuit Judge James Weddle will conduct a bench trial on June 29 to determine if the sale of the Adair County Rescue Squad property to Preston Dean Pyles in 2007 should be set aside or stand as is.
The property in question is the 13 1/4 acres of land and building located off KY 55 North that the officers of the Adair County Rescue Squad, Inc. - Marcia Roberts, Steve Foster and Rodney Brandenburg - sold to Pyles for the sum of $150,000. The deed to the property was transferred to Pyles on May 16, 2007.
In December of last year, Judy Vance, Receiver for the Adair County Rescue Squad, filed a motion in Adair Circuit Court for a partial summary judgment that sought to have the deed of conveyance set aside.
In her motion, Vance stated that the sale of the land did not comply with the requirements set forth by Kentucky law for the sale of property belonging to a non-profit corporation such as the rescue squad. She also stated in the motion that the officers did not have the authority to sell the property in the manner it was sold.
However, earlier this year, Judge Weddle issued an order overruling Receiver Vance's motion for a partial summary judgment.
In his ruling, Judge Weddle stated that it would be ifmproper for the court to grant partial summary judgment as it would deny litigants the right to trial if they have triable issues.
After the motion was denied, Vance then petitioned for a trial on the matter, and Judge Weddle then set the trial date for June 29.
