Ex-District Judge Elliot On Theft Charge

Former 29th Judicial District Judge Roger Elliott has been indicted in Pulaski County for theft by deception, and Pulaski County officials are searching for him to serve the indictment warrant.
A Pulaski County Grand Jury indicted Elliot last month on one count of theft by deception for allegedly issuing a cold check to a Somerset attorney.
According to the indictment, on or about June 5 of this year, the 58-year-old Elliott wrote a check to attorney John Gillum in the amount of $8,194.25, "knowing that the check would not be honored and paid by the drawee bank."
According to an article in yesterday's Commonwealth-Journal, Pulaski County Sheriff Todd Wood was quoted as stating that deputies are attempting to make contact with Judge Elliott to serve the warrant, but had not been able to locate him as of last week.
Contacted yesterday afternoon, a spokesperson for the Pulaski County Sheriff's office said that the warrant was still active and Elliott had not yet been found.
Elliott, from Casey County, served a total of 23 years as District Judge for the 29th Judicial District, which is composed of Adair and Casey counties.
He was appointed as District Judge in 1984 after then-District Judge Paul Barry Jones was elected Circuit Judge. Elliott, who was serving as Judge Jones' trial commissioner at the time of his appointment, was elected to fill the remainder of Jones' unexpired term, and then was elected to four more terms before retiring in December 2006.
Following his retirement, Elliott was given Senior Judge status, and traveled the state filling in for other district and/or circuit judges or handling special cases.
According to the Commonwealth Journal article, Leigh Anne Hiatt, spokesperson for the Administrative Office of the Courts, Elliott is still active as a Senior Judge, but has not been assigned to sit on any cases "until his legal issues are resolved."
